Terms of purchase Stöten Food & Drinks

 

  1. About Sälen Restauranger AB

The Stöten Food & Drinks app and/or e-commerce site (the "App/Site") is provided by Sälen Restauranger AB with company registration number 556852-5504 (the "Seller", "we", or "us"). If you wish to contact us, you can find our contact details in section 12 below.

 

  1. About the terms of purchase and purchases via the App/Site

These terms and conditions apply to orders and purchases of products and services via the App/Site. A purchase agreement is initiated via the App/E-commerce site and shall be deemed to have been concluded when we have confirmed your order in the order confirmation or, if this occurs earlier, when you have started using an ordered service.

 

  1. Prices and products

Prices for products and services are shown including VAT in the currency indicated. At checkout, the total price is presented, including all charges such as shipping fee, handling fee and the like.

 

We aim to keep the App/E-commerce site up to date with any changes to the product range, but we reserve the right that some products may be out of stock. We endeavour to ensure that all prices and product descriptions in the App/E-commerce site are completely accurate, but we reserve the right to make errors.

 

  1. Order

Orders are placed in the App/marketplace. When ordering, you must provide your email address, name and telephone number. All personal information provided when ordering must be correct and relate to the person ordering the products. We are not responsible for non-delivery due to insufficient or incorrect information provided when ordering. All your orders can be found under History in the App or by email on the e-commerce site.

 

  1. Payment

The checkout presents the payment methods available for each product or service. Payment is made by card payment, Swish or otherwise in accordance with the purchase and payment conditions that apply to each payment method and which are specified in connection with the purchase. Receipt will be sent electronically to your specified email.

 

Card payment

We accept payment by Visa, MasterCard. Your payment card will be debited directly.

 

Payment by Swish

We accept payment by Swish. The payment is debited directly to the Swish-associated telephone number given at the time of payment. When paying with Swish, you will be asked to open the Swish app and to identify yourself with an e-identity.

 

  1. Order confirmation and delivery

Once we receive your order, we will confirm it directly in the App/Site. Once your order is confirmed and ready for delivery, you will receive an order confirmation in the App/Site.

 

Available delivery options are presented at the checkout, you choose the delivery option yourself when you place your order.

 

  1. Cancellation (right of withdrawal)

When you shop via the App/E-commerce site, you have the right under the Distance Contracts Act to withdraw from the order (right of cancellation) by notifying us within 14 days. For purchases of services, the deadline is counted from the date of the order, and for purchases of goods, from the date you receive the goods. We will then refund the fees you have paid for the product or service in question. You will have to pay the cost of returning the goods yourself.

The right of withdrawal only applies on condition that (i) the product is returned in undamaged condition, or (ii) we have not started the delivery of the service for which you wish to withdraw an order. Please note that the sale of food is not covered by the right of withdrawal.   1. Product guarantees

We do not provide any guarantees on the products you buy and order from us, but you always have the right to complain about a faulty product within three years of your purchase (see point 9). To the extent that the manufacturer of a product provides guarantees, such guarantees will of course apply to the product.

 

  1. Complaints

When you receive your products, it is important that you check that they are not damaged or faulty. If you think that a product or service you have received is faulty, you must make a complaint within a reasonable time by contacting us. We will then investigate the complaint and inform you whether we can accept the complaint and, if so, how we will remedy the defect, e.g. by re-delivery, price reduction or refund. Any refund will be made as soon as possible and at the latest within 30 days from the date the complaint is finalised.

 

  1. Intellectual property rights

Your use of the App/E-commerce Site does not transfer any copyright or other intellectual property rights to you. You may not use, copy, modify or otherwise deal with any software or other material belonging to us or our affiliates (such as, but not limited to, information and images made available through the App/E-commerce Site), nor transfer or assign any rights to such software or material to any other person.

In order to receive, manage and deliver your order, Säljbolaget will process your personal data. All our processing of personal data is done in accordance with applicable personal data legislation. You can read more about how we process your personal data in our privacy policy.

  1. Force Majeure
    We shall not be liable for damage or non-performance as a result of strikes, fire, acts of public authority, labour disputes, accidents, failure or delay of subcontractors, breakdown of public communication systems or other circumstances beyond our control and which we could not reasonably be expected to anticipate and the consequences of which we could not reasonably have avoided or overcome. If a circumstance in accordance with this clause 13 persists for a period exceeding 1 month, the party shall be entitled to terminate with immediate effect any purchase agreement whose fulfilment is prevented by such circumstance.

 

  1. General limitation of liability

Our liability for products and services supplied is subject to their proper use. Our other liability for damages that may arise from defects in products and services that we supply is limited to what follows from applicable mandatory law. Unless mandatory law provides otherwise, we are not liable in any case for indirect damage or loss, and our liability to you is, in the absence of intent or gross negligence, limited to the consideration paid by you for the product or service concerned.

 

To be eligible for any compensation for damage, your claim for compensation must be made within a reasonable time from the time the damage was discovered or should have been discovered.

 

  1. Change of contractual terms

We reserve the right to amend these terms and conditions from time to time. For completed purchases, the terms and conditions that have been approved and accepted by you in connection with the current purchase always apply.

 

  1. Disputes and applicable law
    Disputes regarding the validity, interpretation and application of these terms and conditions of purchase shall in the first instance be settled by negotiation between the Sales Company and you as a customer. If such negotiations fail to resolve the dispute, the dispute may, at your request, be reviewed by General Complaints Board, ARN. The dispute may also be heard by a general court, in which case Swedish law shall apply.

Privacy Policy Stöten Food & Drinks

Your privacy is important to Sälen Restauranger AB (hereinafter "us" or "we"). When you use our mobile application and/or e-commerce site Stöten Food & Drinks (hereinafter "Platform"), your personal data may be processed by us. We want to ensure that your personal data is processed in a lawful, secure and transparent manner.

This privacy policy aims to describe why we process your data, when we do so and how we process it. It also explains our obligations and your rights.

 

Who is responsible for your personal data

We are the controller of the personal data processing required to receive, administer and fulfil an order via the Platform, and to administer any user account in our Platform. We are also responsible for the processing of personal data for the purpose of keeping statistics on how many individual users we have on our platform and how often these individual users visit the platform.

Our platform is provided via Caspeco AB, which is our data processor in this respect. This means that Caspeco AB only processes your data in accordance with our instructions.

In cases where payment is required to finalise or order, standard online payment information is collected. Data is stored in a PCI certified environment and the data cannot be seen by us or our data processors in plain text.

 

What personal data we process

When you place an order through our platform, create a user account in the platform, we need certain data about you to fulfil your request, administer your user account in the platform. These data are first and last name, e-mail address, telephone number, geographical data and payment data. We only process personal data that you have voluntarily chosen to share with us.

 

Purpose and legal basis of the processing

We use your personal data to process and finalise your order via our platform, and to administer your payment. If you have chosen to create a user account on our platform, we use your data to administer your user account. This processing is necessary for us to fulfil our contract with you.

We also use your personal data to keep statistics on how many individual users we have on our Platform and how often those individual users visit the Platform. This statistical processing is carried out on the basis of a legitimate interest in providing you with an improved version of our platform.

 

How long your personal data is stored

Once you have placed an order via our platform, we will store your personal data until your request is finalised by us.

If you have chosen to create a user account in our platform, we will store your personal data for as long as you have a user account and for a maximum of twelve (12) months thereafter. If you request it, this storage period can be shortened.

We also retain your personal data for statistical purposes for a maximum of twelve (12) months from the current use of our platform. Statistics containing data that are not considered personal data are stored indefinitely.

In addition, your personal data may be stored for the period required by applicable law.

 

Who gets access to your personal data

We share your personal data with Caspeco AB, which acts as a data processor. This means that they only process your data in accordance with our instructions.

We may also share your personal information with third parties, provided we are required to do so by law. Please note, however, that we do not sell your personal information to third parties.

 

Transfer of personal data outside the EU/EEA

As a general rule, we and our partner(s) process personal data only within the EU/EEA.

If processing takes place outside the EU/EEA, there is either an adequacy decision by the European Commission or appropriate safeguards, such as the European Commission's standard data protection clauses or binding corporate rules, apply to ensure that the personal data is protected.

 

Your rights

Right of access: You have the right to contact the controller and request access to the personal data processed about you and request information (so-called register extract) about, inter alia, the purposes of the processing, who received the personal data, etc. An administration fee may be charged for any additional copies.

Right to rectification and restriction: You have the right to have your personal data rectified or, under certain conditions, restricted without undue delay. If you believe that the controller is processing personal data about you that is inaccurate or incomplete, you can request that it be rectified or completed.

Right to erasure: Under certain conditions, you have the right to have your personal data erased (right to be forgotten). For example, if the personal data is no longer necessary for the purpose or if the processing is based on consent and this has been withdrawn. However, there may be legal or contractual requirements that prevent the controller from erasing your personal data.

Right to object and withdraw consent: You have the right to withdraw your consent with effect from the time of withdrawal. You also have the right to object at any time to the processing of your personal data if the legal basis for the processing is a balance of interests. As a data subject, you also have the right to object at any time to the processing of your personal data if they are processed for marketing purposes and they will no longer be processed for this purpose.

Right to data portability: You have the right to receive assistance to transfer the personal data you have provided to the controller in a structured, commonly used and machine-readable format to another controller. However, this applies provided that it is technically feasible and that the processing was necessary for the fulfilment of a contract or that you have given your consent.

Right to lodge a complaint: If you are dissatisfied with the processing of your personal data, please contact the controller, see contact details below. You also have the right to lodge a complaint with the supervisory authority, the Data Protection Authority (www.imy.se).

 

Changes to this privacy policy

We reserve the right to change and update this privacy policy. In the event of substantial changes or if existing personal data is to be processed differently from what is stated in this policy, we will inform you of this in an appropriate manner.
